Medical Leaves

Are you frequently missing work due to medical reasons, or do you anticipate a need for an extended leave?

Family Medical Leave Act (FMLA) and/or Oregon Family Leave Act (OFLA) may be an option for you.

Qualifications

Who/What can I take a medical leave for?

OFLA

  • Worked for employer for at least 180 days;
  • Have worked an average of at least 25 hours per week for 180 days immediately preceding the leave (excluding parental leave).

FMLA

  • Worked for employer for at least 12 months;
  • Have at least 1,250 hours of service for the employer during the 12 month period immediately preceding the leave.
  • Own serious health condition* (FMLA only)
  • To care for someone with a serious health condition* (Spouse/Domestic Partner, Son/Daughter, Mother/Father, Grandparent/Grandchild) (FMLA only)
  • Parental Leave (FMLA only)
  • Pregnancy Disability (FMLA and OFLA)
  • Taking custody or Placement of an Adopted or Foster Child (FMLA only)
  • Leave to effectuate the legal process required for placement of a foster child or the adoption of a child (between July and December 2024 only) (OFLA only)
  • Sick Child Leave* (OFLA only)
  • Extended Bereavement (OFLA only)*Medical Certification must be provided.


How to Request a Medical Leave

Step 2: Health Care Provider Certification

  • Complete FMLA/OFLA Application
  • Return to Human Resources at hr@silverfalls.k12.or.us, or fax to (503) 873-2936.
  • Download and print the Healthcare Provider Certification form.
  • Request that your medical provider complete the document.
  • Return to Human Resources at hr@silverfalls.k12.or.us,
    or fax to (503) 873-2936.


Important Notes

  • You may take up to 12 weeks (60 days) of job-protected time off for a qualifying event.
  • FMLA & OFLA are considered unpaid leaves, but we will use your available contractual leaves to keep you in a paid status.
  • For information on how to apply for Paid Leave Oregon, please visit our Paid Leave Oregon page.
  • You must apply for leave at least 30 days in advance of needing it, unless in the event of an emergency.

Paid Leave Oregon

Paid Leave Oregon is a new program that allows individuals to take paid time off for important life moments. Employers can offer these benefits through an equivalent plan provider approved by the Oregon Employment Department.

Paid Leave Oregon can be combined with FMLA/OFLA qualifying leave.

American Fidelity is the Silver Falls School District’s Paid Leave Oregon equivalent plan provider. Employees apply for and receive benefits directly from American Fidelity.
